• An agreement not to rely on national immunity is an endorsement of liability policies that expresses the agreement of the insurer not to rely on statutory limitations on state immunity unless requested by the policyholder. It is used when government agencies have limited liability or full immunity under state law, but the government agency may waive that immunity or limitation of liability on a case-by-case basis. Although there are rare occasions when it is necessary to waive statutory restrictions, this approval leaves control to the insured.
