• A constructive termination is an attempt by an employer to force an employee to resign (rather than fire the employee) by making the employee’s working conditions extremely unpleasant. Structural termination claims are considered “workplace torts” and are covered by Employment Practices Liability Insurance (EPLI) policies. To support a constructive termination claim, employees must prove that either the terms of employment are directed at the employee personally or that the terms violate fundamental constitutional rights. (Simply unfair terms of employment, such as unequal pay scales between men and women, may not necessarily warrant a claim.)
