• The Continuing Care Rule is a common law liability doctrine stating that if a physician has treated a patient for a specified period of time, only one policy limitation applies—the one in effect at the time the claim is filed. This rule prevents a “capping” situation where the overall policy limits (which were available for the duration of the treatment) could otherwise be applied to this type of claim. The continuous referral rule may also apply to other professionals, most commonly lawyers and accountants, whose services on a particular case or case sometimes take several years.
