• A non-enforcement agreement is an agreement by a plaintiff in a lawsuit not to enforce a judgment against a defendant. Default agreements are sometimes given to the insured in exchange for the insured’s agreement to allow the determination of consent and assignment of the insured’s potential bad faith claim against the liability insurer.
