• Establishing claims are a type of claim filed by a physician alleging that he or she has been mistakenly denied staff privileges (i.e., the right to see and treat patients) in a hospital or related medical facility. The denial of admissions privileges by grading committees is a frequent source of lawsuits brought against both hospitals and individual physicians serving on such committees by physicians who have been denied admissions privileges. Both physicians’ professional liability policies and hospitals’ professional liability policy forms explicitly cover what is known as “authorized requirements”.
