• Enforceable requirements are conditions or restrictions on permits issued under the Clean Water Act, Section 402 or 404, the violation of which may result in a compliance order or civil or criminal action under federal or applicable state law. If a permit has not been issued, this term includes any requirement that the regional administrator (RA) believes will be included in the permit when it is issued. If a permit does not apply, this term includes any requirement that the RA considers necessary in order for the best practice waste management technology to meet the applicable criteria.
