• Excessive Remuneration Claims are a type of claim placed on trustees responsible for overseeing 401(k) plans. These claims state that the fees charged by the plan’s external administrator are significantly higher than the average fee (usually stated as a percentage of the total funds held by that 401(k) plan). When multiplied over a significant period of time (such as 20 to 30 years), a fee that is only 1 or 2 percent higher than the regular fee can reduce a 401(k) plan holder’s balance by many thousands of dollars. And when a group of employees band together in a class action lawsuit alleging that the employer’s 401(k) plan is charging excessive fees, the damages claimed can exceed $100 million.
